DRAFT – not legal advice. This text has not been reviewed by a solicitor and must be checked before launch. Text in [square brackets] still needs to be filled in. 1. About these terms These terms apply when you use StudentTask Galway ("StudentTask", "we", "us") on the website or in the iPhone and Android apps. StudentTask is run by [legal name of the business], [registered address], [company number if any]. By creating an account you agree to these terms, the Privacy Notice, the Cancellations and Refunds policy and the Community Guidelines. 2. What StudentTask is StudentTask is a marketplace that introduces people who need help with everyday tasks ("customers") to local college students who offer to do them ("students"). We provide the website, the apps, messaging, payments and support. We do not do the jobs ourselves and we are not a party to the agreement between a customer and a student, except where these terms say otherwise. Students are independent. They are not employees, workers or agents of StudentTask, and they decide which jobs to apply for, what price to ask and how to do the work. Students are responsible for their own tax and for any registration their work needs. 3. Who can use StudentTask You must be at least 18 years old and able to enter into a binding agreement. Students must be enrolled at a college or university. You may hold one account, and the information you give us must be true and kept up to date. You are responsible for keeping your password safe and for anything done using your account. 4. Posting a job Customers describe the task, the location, the date and a proposed budget. Describe the job honestly, including anything that affects safety, such as heavy lifting, animals, heights or working alone with someone. Your exact address is shown only to the student you hire and to authorised support staff. 5. Applying, offers and the agreed price Students apply with their own price and a message. When a customer sends an offer and the student accepts it, the customer and the student have an agreement to do that job at the price shown as the "agreed job price". That is the total the customer pays for the job. Either side can propose a change to the price or the scope, and the change applies only if the other side accepts it in the app. 6. Payments and commission The customer pays the agreed job price through StudentTask. StudentTask charges the student a commission on each paid job, which is taken from the student's earnings. The current rate is shown at checkout and is saved with each payment, so a later change to the rate never affects a payment already made. Customers pay no booking fee. [Confirm whether VAT applies to the commission.] During the pilot, payments are simulated test transactions and no money moves. When live payments start they will be processed by Stripe, and Stripe's own terms will also apply. StudentTask is not a bank or an escrow service. A student's earnings are paid out after the job is marked complete; if a problem has been reported, payout waits until support has reviewed it. Keep payments on StudentTask. Asking for or making payment outside the platform for a job found here is not allowed, and it removes the protection that support and the dispute process give you. 7. Doing the job Students must do the work with reasonable care and skill, at the agreed time, and as described in the job. Customers must give the student safe access to the place of work and anything else agreed. Either side can message the other in the app. When the work is finished the student asks the customer to confirm it, and the customer either confirms it or asks for changes. 8. Cancellations, refunds and problems Cancellations and refunds follow the Cancellations and Refunds policy. If something goes wrong, report a problem from the job page. Support reviews the job details, the messages and the timeline, and may refund the customer, release payment to the student or ask both sides to continue. Support decisions do not affect any legal rights you have. 9. Verification A "Verified student" badge means an administrator reviewed evidence that the person is enrolled at a college. It is not an identity check, a background check or Garda vetting, and it does not mean the student is insured or qualified for a particular task. Customers decide who to hire. 10. Reviews and content After a job is completed, the customer and the student can review each other. Reviews must be honest and about the job. You keep ownership of the text and photos you add, and you give StudentTask a non-exclusive, royalty-free licence to show them on the service and use them to run it. Do not upload anything you do not have the right to share. 11. Things you must not do You must follow the Community Guidelines. In particular, you must not use StudentTask for anything illegal, unsafe or discriminatory, post jobs that require a licence or vetting the student does not hold, harass anyone, create fake accounts or reviews, or try to get around the platform's security. 12. Suspension and closing your account We may suspend or close an account, remove content or cancel a job if we reasonably believe these terms or the law have been broken, or to protect someone's safety. We will tell you why unless the law or safety prevents it, and you can contact support to ask us to look again. You can delete your account at any time from Account settings once you have no active jobs. Some records are kept after deletion, as explained in the Privacy Notice. 13. Our responsibility to you Nothing in these terms limits your rights as a consumer under Irish and EU law, or our liability for death or personal injury caused by our negligence, or for fraud. Because the jobs are done by independent students, StudentTask is not responsible for the work itself, for damage or injury caused during a job, or for loss of items, except where the law makes us responsible. StudentTask does not insure jobs. [Limitation of liability wording and any cap to be set by a solicitor.] 14. Changes to these terms We may update these terms, for example when live payments start. We will tell you about important changes in the app or by email before they apply. If you keep using StudentTask after that, the new terms apply. 15. Law and complaints These terms are governed by the law of Ireland, and the Irish courts have jurisdiction, but if you live elsewhere in the EU you keep the protection of the law where you live. Contact us first through the Support page or at [support email] and we will try to resolve any complaint.
